Agreement Between the User and pepiniere.ca

Online store operated by: Centre de jardin Floréal inc. and Centre de jardin Brossard inc.

Access to, browsing of, use of the website pepiniere.ca, and any purchases made through it are governed by these Terms and Conditions of Use and Sale.

By using this website or placing an order, you acknowledge that you have read, understood and accepted these terms. We may update these terms for future use and purchases. An update does not retroactively change the terms of a contract already concluded; mandatory rights provided by law remain applicable.

Legal Capacity

By using this website or making a purchase, you represent that you have reached the age of majority in your province or territory of residence, or that you have obtained permission from a parent or legal guardian.

Website Use

You agree to use the website lawfully, reasonably, and in accordance with these terms. It is prohibited to use the website for fraudulent, abusive, unlawful purposes, or in any way that could interfere with the proper operation of the online store.

Prohibited Actions

• Damaging, disabling, or disrupting the operation of the website.
• Attempting to access unauthorized sections of the website or its systems.
• Exploiting security vulnerabilities or attempting to obtain confidential information.
• Using the website for fraudulent purposes or in violation of applicable laws.

Products, Pricing, and Availability

We make every reasonable effort to display accurate information regarding products, pricing, descriptions, images, sizes, availability, and timelines. However, errors may occur.

We correct errors in pricing, descriptions, images, availability or inventory when they are identified. Correcting information on the website does not automatically change an order for which a contract has already been concluded and does not, by itself, entitle us to cancel it, refuse delivery or demand a higher price.

Images of plants are provided for illustrative purposes only. The size, color, shape, flowering, and appearance of a plant may vary depending on the season, stage of growth, availability, and natural conditions.

Pricing and Display Errors

If an error affects an order for which a contract has already been concluded, we contact the customer to address the situation in accordance with the contract and applicable laws. No change to the price, products or fees is imposed solely because of an error on our part. A solution agreed with the customer does not limit their mandatory legal rights or remedies.

Orders and Payment

The prices, fees and delivery options applicable to an order are presented before confirmation. If there is a payment issue, an indication of fraud or incomplete information, we may carry out necessary checks and contact the customer. Any action concerning an order for which a contract has already been concluded must comply with the contract and applicable laws; these checks do not create a general right to cancel or increase the price.

Available payment methods are displayed at checkout. When Sezzle is offered, customers may split their purchase into installments according to Sezzle’s terms and conditions. Approval, installment payments, and service terms are managed by Sezzle.

Order Refusal or Cancellation

If a product is unavailable or there is a difficulty fulfilling an order, we inform the customer and seek an appropriate solution together: an expressly accepted replacement, an agreed new delivery date, or an agreed cancellation with reimbursement of the corresponding amounts. No replacement or additional charge is imposed. Cancellation by the business must have a basis permitted by law or be agreed with the customer; a refund does not, by itself, eliminate other remedies available under the law.

Koppert Pre-Orders — Living Organisms

For Koppert living organisms, the specific conditions below replace the general pickup and shipping timelines.

Full payment is required when ordering. Order deadlines are the 15th and 30th of each month, up to and including 11:59 p.m. (Quebec time). In February, the second deadline is the last day of the month. Arrival at the store is expected on the Wednesday of the week following the batch deadline. The dates for your batch are shown on the product page and in your order.

Pickup is required from Thursday through Sunday following arrival, inclusive, during opening hours, and only after you receive your “ready for pickup” confirmation. Wait for this confirmation before visiting. Select pickup in Laval (Centre de jardin Floréal) or Brossard when ordering.

Burq delivery is available only to eligible addresses within the currently serviced Greater Montreal area, according to the options offered at checkout. These living organisms are not shipped outside this area.

Final sale: no returns, exchanges, cancellations or refunds for a change of mind. Orders not collected within the stated pickup period are not eligible for a refund. These conditions do not limit legal warranties or other mandatory rights provided by law. If there is a problem with your order, contact us promptly at commandes@pepiniere.ca.

Shipping, Pickup, and Pre-Orders

Orders placed on pepiniere.ca are subject to our shipping, warranty, pre-order, in-store pickup, return, refund, and exchange policies.

Shipping is available based on the product type, delivery area, time of year, and options available at checkout. Certain products, including bulk materials, may be subject to specific fees, timelines, delivery areas, or exclusions.

Pre-order products are considered final sale unless otherwise specified. When an order contains both in-stock and pre-order items, shipment may be made in a single delivery once all products are available, unless otherwise agreed upon or additional fees are paid for separate shipments.

For pickup orders, customers must wait for a confirmation notice before coming to the store. Orders must be collected within the timeframe specified in our pickup policy.

Returns, Exchanges, and Refunds

Return, exchange, and refund requests are handled in accordance with our Refund and Exchange Policy. Certain products are excluded, including clearance items, final sale items, pre-orders, products carrying certain labels, or promotional items subject to posted conditions.

Shipping fees are non-refundable, except in the case of our error or when a product arrives damaged and the claim is approved.

Any damaged or defective product upon delivery must be reported by email to commandes@pepiniere.ca within 48 hours of receipt, including the order number and clear photos of the product, box, and packaging.

Living Plants and Plant Material

Plants, trees, shrubs, perennials, annuals, seeds, and other plant materials are living products. Their performance, growth, flowering, and survival depend on many factors beyond our control, including watering, soil conditions, planting methods, exposure, temperature, diseases, insects, animals, maintenance, and weather conditions.

Pepiniere.ca cannot be held responsible for improper care, incorrect planting, lack or excess of water, adverse weather conditions, or any situation beyond its control after the product has been delivered or picked up.

Plant Warranty

Unless otherwise stated in writing, no express or implied warranty is provided regarding the survival, growth, flowering, fruit production, or future performance of plants after delivery or pickup.

Any applicable warranty, where offered, is limited to the conditions expressly displayed on the product page or communicated in writing by Pepiniere.ca.

Promotions, Discounts, and Exclusions

Promotions, discounts, promotional codes, and free shipping offers are subject to the conditions displayed at the time of purchase. Certain product categories may be excluded, including bulk materials, clearance items, final sale items, pre-orders, or any other product identified as excluded.

Promotion conditions and exclusions must be reflected in the price and fees presented before order confirmation. An error in applying a promotion does not result in an additional charge imposed after the contract has been concluded. If the customer subsequently requests a change, such as additional quantities or a new address, its effects on the price and delivery are presented to the customer and must be expressly accepted before the change is made.

Force Majeure

Pepiniere.ca shall not be liable for delays, inability to deliver, cancellations, or failures to perform resulting from events beyond its reasonable control, including but not limited to natural disasters, extreme weather conditions, pandemics, labor disputes, transportation disruptions, product shortages, equipment failures, computer system failures, or governmental actions.

Links to Third-Party Websites

The pepiniere.ca website may contain links to external websites operated by third parties. These websites are neither controlled by nor the responsibility of pepiniere.ca or its operators.
